In recent years, there have been frequent international patent disputes related to LED lighting. Although there are not many litigations related to domestic LED lighting companies, there are similar events such as the “337 investigations†that occurred in 2008. Another "337 investigation" incident recently came from the United States, which is said to involve nearly 10 enterprises in China. It can be seen that domestic LED lighting companies are facing increasing legal patent risks. The author believes that the main reason is: on the one hand, the rapid development of the domestic LED lighting industry has brought considerable competitive pressure to foreign manufacturers, while foreign manufacturers are coveted by the rapidly growing Chinese LED lighting market; on the other hand, the current LED The core patents of the lighting industry are basically controlled by foreign manufacturers, and a strict patent network has been formed, while domestic LED companies have few core patents. This makes domestic LED lighting companies will not be able to fight back if they encounter patent attacks initiated by foreign manufacturers.
For the current situation, many experts in the domestic LED lighting industry and intellectual property circles have given high attention and have raised warnings. At the same time, it is also recommended that domestic LED lighting related enterprises should actively formulate appropriate patent strategies and implement them. Accumulate high quality independent intellectual property rights. The corresponding measures may include: focusing on technical R&D and patent layout on weak points of patent barriers, gaps in current technology research and development, and important nodes for future technological development; actively conducting negotiations with foreign manufacturers to obtain patent authorization; Institutional cooperation, the introduction of research and development talents, strategic acquisition of technology with potential value, active digestion and secondary innovation; and, strengthen the construction of patent alliances, set up a patent pool, and cooperate against foreign militant manufacturers.
The above-mentioned various measures can certainly achieve the purpose of easing or resolving the passive patent situation faced by domestic enterprises. However, the author believes that we cannot ignore another important way to achieve this goal, namely to strengthen domestic LED lighting enterprises and Exchanges and cooperation between domestic universities and research institutes and other scientific research institutions. According to statistics, at present, a considerable proportion of domestic LED invention patents come from scientific research institutions, and there are many original high-quality patents, but there are only a handful of transfer convertors, and they are voluntarily abandoned after various authorizations. There are countless others, which is really deplorable.
In this article, the author would like to conduct preliminary statistics and analysis on the LED-related invention patents owned by the Chinese Academy of Sciences and its affiliated institutions (hereinafter referred to as the Chinese Academy of Sciences), in order to provide inspiration and benefits for domestic LED lighting companies in implementing the patent strategy.
